Welcome! Before participating in Yogatility’s services, we need you to thoroughly read, understand the following which contains our service agreement. The following Service Agreement (the “Agreement”) will clearly communicate our expectations in working together. If you have any questions, please raise any questions before signing up to our services (email karen@yogatility.com), to make sure we are all on the same page moving forward. 1. The yoga instructor and yoga informed life coach is Karen Campbell and this Agreement is made between [Yogatility], a business operating in Wales, United Kingdom (“Business name,” “we,” “us,” and “our”) and you, the client undersigned (electronically or by hand) or person who has clicked “I Agree” (or something similar) to this Agreement (“you” and “your”) when signing up to use yogatility’s services. 2. The coach will not direct the client to a course of action but will support the client in making the right decision for themselves. As such, the client agrees that yogatility is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided. 3. Ownership. You are responsible for your own physical, mental and emotional well- being and actions during the course of the services. By participating in any Services with Yogatility, you affirm that you have sought medical advice regarding your fitness or are certain of your ability to engage in the Services. If you have any pre-existing medical conditions you should consult with your doctor first before engaging in the Services. Please communicate and inform us IMMEDIATELY if at any point you do not feel well during the Services. 4. Our Commitment to You. We promise to provide you with life coaching and yoga services (where applicable) in order to provide the best possible experience. 5. Yogatility will provide one free 30 minute clarity call per client. This is an introductory call and will not include coaching or, yoga. Further appointments and services are chargeable at rates stated and require payment in full at the time of booking. 6. Our private one-on-one offerings will be customized to your unique individual needs, goals and abilities. Scope of sessions. The scope of our sessions may include one or, a combination of the following: Hatha/Vinyasa Yoga, Life Coaching, Somatic Yoga, Meditation, and Breathwork. 7. Equipment. During the Services, we encourage creativity regarding the equipment you use. These options could be any standard pieces of yoga equipment, such as blocks, bolsters, straps, mats, resistance bands, pillows, dumbbells, foam rollers, and massage balls, or you can make use of anything that works for you, such as your bed or blankets (the “Equipment”). Please understand that you are fully responsible for the equipment you select to use and understand the risks associated with your choice. 8. Here is what we will not be doing together: Talk therapy, hypnotherapy, reiki, cognitive behavioural therapy, physical therapy, medically diagnosing or treating specific health conditions or diseases. Life coaching does not substitute for therapy if needed. 9. We value communication, so we will do our best to clearly communicate with you about any preparation instructions, follow-up information, or scheduling details related to your Services. 10. Sessions taken with yogatility will not be recorded (voice and/or video) unless yogatility and participants (you, the client) agrees. 11. Participating in the Services online poses risks, as there is no in-person supervision or space provided. You will, therefore, need to ensure the safety of the Services by using your judgment on how to best practice them, not pushing yourself too far, and not attempting anything you feel unsure how to perform. 12. If the Services are being performed outdoors, there are additional risks such as tripping or collision with human or natural elements, sun exposure, dehydration, insects, exposure to infections, diseases, pollutants, and other environmental factors. You understand and agree it is your responsibility to ensure a safe space and environment to perform the Services. 13. Yogatility shall not be liable for any injury resulting from or arising out of participating in yogatility’s services. You also understand that yogatility encourages you to exercise and eat healthily. 14. Alcohol and Prohibited Substances. You are strictly forbidden from participating in the Services while under the influence of alcohol or any other substances that may alter your perception or ability to be present and focused. 15. Yogatility is not responsible nor liable for any subsequent course of treatment that maybe chosen by the client, nor is yogatility responsible or liable for the outcome of the treatment. 16. Qualifications. We hold the following professional qualifications and certifications: I am qualified yoga instructor, yoga informed life coach and a trained embryologist with over 20 years working in the fertility sector. 17. For clients choosing to participate in Yogatility services, the information on this website (www.yogatility.com) and the content discussed during any consultation is for general informational purposes only. 18. Any and all information related to yoga, life coaching and fertility is provided in good faith and based on qualified knowledge, however it is not intended or implied to be a substitute for the professional medical advice, diagnosis or treatment. 19. Yogatility makes no representation and assumes no responsibility for the accuracy of general information related to life coaching, yoga and fertility as such general information is subject to change in these dynamic fields. 20. No Guarantees. Yogatility cannot guarantee the success of, or any particular outcome from the Services. 21. What We Expect of You. Just as you are investing in us, we are also investing time and energy in you. For you to gain the most from the Services, here is what we expect of you: 22. Respect. We expect you to show kindness and respect to all staff and everyone you interact with at yogatility. Both parties will treat each other with respect and any aggressive behaviours towards the coach will not be tolerated and may result in the immediate cessation of the session without a refund. 23. Time Integrity. We expect you to show up on time to each scheduled session, ready to participate. Any late arrival from the client will result in a shorted session that day. Both parties will touch base if delays are expected. We also expect you to honour the cancellation policy detailed below. 24. All services are strictly confidential, and client’s details will remain protected in accordance with GDPR. Minimal information will be stored, including the client’s first name and surname, key relationship names and a brief summary of session(s). information is stored on a google drive (which is password protected) for 6 years. Thereafter, all information will be deleted. We employ reasonable measures to protect your personal information, however no method of transmission over the internet or, electronic storage is 100% and we cannot guarantee absolute security. 25. Confidentiality will be maintained unless there is a risk to yourself or others. 26. Commitment. We expect you to be committed to the Services. 27. Inherent Risks. You understand that participation in the Services may pose inherent risks, some more serious than others. These risks can result in serious harm and injuries that could change your quality of life, your ability to earn an income and, in very rare and extreme circumstances, could even result in death. You assume any and all risk and danger incidental to the use of in person (live or, online) yoga, coaching, videos and any other material offered by yogatility, including but not limited to the foregoing risks and the way you perceive and utilize the information conveyed by yogatility’s services and videos. 28. Ownership of Materials. All the content that maybe provided to you, including but not limited to videos, documents and PDFs, are for your use only and are not to be re- distributed or re-used. You will respect all copyright laws; no part of our content can be replicated, distributed, reproduced, or sold in your own materials. 29. Yogatility practices under the jurisdiction of the UK, any issues that arise are to be dealt with under UK law. 30. Force Majeure. Yogatility will not be liable for any failure or delay regarding the Services if such failure or delay is: beyond the reasonable control of yogatility, could not have been reasonably foreseen or provided against, or due to events such as a pandemic, natural disaster, or other Act of God. In such an event, you will not be entitled to any refunds or recovery. Cancellation and Refund Policy Integrity and keeping your word are the cornerstones of all success. With that in mind, this is how we’ve drafted our cancellation and refund policy: Refunds. All sales are final. Services are non-refundable. Reschedule Policy. Please give at least 48 hours notice if you have to reschedule a one-on-one session. If you give less than 48 hours notice, your session will not be rescheduled. Clients can reschedule each session twice free of charge and thereafter will be charged £20 for each additional reschedule for that session. T&Cs version 1
